This following constitutes the data retention and litigation policy ("Policy") of Public Record Watch LLC ("PRW LLC"), a government watchdog limited liability company duly registered in the state of Hawaii. This Policy outlines the terms and conditions governing the retention of information exchanged between parties engaged in business transactions with PRW LLC, as well as the procedures for recourse through litigation in the event of non-compliance with local public records laws.
- Information Retention: PRW LLC reserves the unequivocal right to obtain, retain, and utilize all information exchanged between parties conducting business with PRW LLC. Such information encompasses, but is not restricted to, the following:
- Names of parties involved in the business transaction.
- Contents of electronic communications, including emails or letters.
- Recordings of telephonic conversations.
- Attachments accompanying electronic communications.
- Response times to requests or inquiries.
- Litigation Protocol: PRW LLC expressly disclaims any arbitration clause within its agreements or transactions. Instead, PRW LLC reserves the exclusive right to initiate litigation proceedings in a court of law to address grievances arising from non-compliance with local public records laws.
- Basis for Litigation: Litigation may be pursued by PRW LLC if records pertinent to its operations and obligations are not furnished in a manner consistent with the applicable local public records laws. Such discrepancies may include, but are not limited to:
- Unreasonably delayed response times to requests for public records.
- Lack of transparency in the provision of public records.
- Any other contravention of statutory obligations regarding the accessibility and disclosure of public records.
- Jurisdiction and Venue: Any litigation initiated by PRW LLC pursuant to this Policy shall be conducted within the appropriate jurisdiction and venue as determined by the applicable laws of the state in which records are requested.
- Severability: In the event that any provision of this Policy is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
By engaging in business with PRW LLC, parties implicitly agree to adhere to the terms outlined in this Policy. PRW LLC reserves the right to amend or modify this Policy at its sole discretion, with any such changes being communicated to affected parties in a timely manner.
